Commercial Rent Stabilization Act (CRSA) also referred to as Intro. 93

The proposed legislation would establish a system of commercial rent registration and regulation applicable to retail stores of 10,000 square feet or less, manufacturing establishments of 25,000 square feet or less, and professional, services or other offices of 10,000 square feet or less. The Mayor would appoint a nine-member Commercial Rent Guidelines Board responsible for annually establishing guidelines and the rate of rent adjustments for covered commercial spaces.

The absence of new construction and the inability to invest in building improvements will lead to deteriorating building conditions and a decline in the overall quality of the city's infrastructure. Legislative Alternatives

An alternative is the Job Survival Act. The most vital factor was that the Jobs Survival Act gave commercial tenants the right to renew long-term, 10-year leases. Many small business owners told a reporter at The Village Sun that this was the most critical need because this right would open the door for the first time to negotiate equally with their landlord the terms of the lease. Without this essential right, the landlord still had total control of the commercial lease renewal process. Without this right, all negotiating in good faith ended and the landlord would tell their commercial tenant, “This is what I want — take it or leave.”

The Village Sun reports that while the CRSA addresses only the limitation of rent increases, it grants complete control over all other lease terms to the landlords. Small business owners have emphasized that the duration of their lease is closely linked to their profits, stability of location, and long-term planning. In essence, the CRSA leaves small businesses entirely at the mercy of property owners, who are likely to continue providing short-term leases (month to month or one to three years), particularly to multigenerational immigrant family store owners. Numerous small business owners expressed their emotional distress, citing anxiety, fear, and uncertainty about their future due to these short-term lease arrangements.
